(4) To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before expiry of the withdrawal period.
(5) In accordance with § 18 para. 1 no. 5 of the Austrian Distance and Off-Premises Contracts Act (FAGG), the right of withdrawal does not apply to sealed goods that are not suitable for return for reasons of health protection or hygiene, provided that the seal has been removed after delivery.
This may apply to food products such as matcha once their protective seal has been opened. Returns of such products are therefore not possible once the seal has been broken. If the seal remains intact, the statutory right of withdrawal generally remains applicable, subject to the applicable legal requirements.
This does not affect your statutory rights in the event of defective, damaged or incorrectly delivered products.
Effects of withdrawal
(1) If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed of your decision to withdraw from this contract.
(2) For this reimbursement, we will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is the earlier.
(3) You must send back the goods or hand them over to us without undue delay and in any event no later than fourteen days from the day on which you inform us about your withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct cost of returning the goods.
(4) You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
